Definitions

"Agreement": This document containing Terms and Conditions.
"You", "Your" or "Customer": The Subscriber of Booking Simple Service.
"Cardholder": Person with the authority for a designated credit card to set up recurring billing.
"We", "Us", "Our" or "Booking Simple": Booking Simple LLC.
"Service": The month-to-month online appointment scheduling service.

Services Provided

Booking Simple provides online access for your appointment scheduling through a monthly subscription service. We are committed to your success and will do everything possible to offer you the highest quality service at the most competitive pricing. Therefore, we do maintain the right to improve and amend our services at any time without notice to our customers.

Booking Simple obtains the right to offer limited customization, integration and other services as needed. Charges and billing options for these additional services will be established on an individual basis.

Pricing, Billing and Taxes

Booking Simple promises to provide Service to the Customer according to this Agreement.

Booking Simple is a monthly subscription service which bills on a monthly cycle. The first monthly billing cycle begins the day after your free 5-day trial expires. Recurring billing for subsequent months will begin after Booking Simple has received a written request from the cardholder to do so (see Recurring Billing Request). This request must be received by the beginning of the next billing cycle or recurring billing will be stopped and the service is at risk of Termination (see 'Terminiation' below). When possible, recurring billing will begin on the same day of the month as the first monthly cycle, or it will be set for the last day of the month. Recurring billing will be maintained until either the Customer or Booking Simple chooses to terminate the subscription (see 'Cancellation' below).

Prices and policies for all our Service options are subject to change. You will be notified via email prior to any price increase that may affect your account. You will receive an email invoice each month after Your credit card has been charged.

The responsibility and payment of any taxes belong solely to Customer.

Client payment for Booking Simple services must be in U.S. Dollars unless previously arranged and agreed upon.

Billing Disputes

Your account will be immediately reviewed and adjustments made where necessary.

Cancellation Policy

There are no penalties or cancellation fees. Customer may terminate service at any time simply by logging into Your account, going to the Update Subscription function and selecting Cancel Account. Cancellation will commence immediately. Therefore, when you cancel during a billing cycle, you forfeit service for the remainder of that cycle. Please note that no refunds will be paid when you forfeit service.

Termination

In the event of the any of the following situations, Booking Simple reserves the right, at our sole discretion, to terminate Your access to our Service:

  • Customer account and contact information may be inaccurate, invalid or incomplete
  • Customer credit card information may be invalid or unauthorized by Cardholder
  • Customer account information may not be established or maintained to represent an actual business or person
  • Customer business operations may be illegal or harmful to any individual, group or organization
  • Customer business operations may in any way negatively impact the reputation of Booking Simple
  • Any reason deemed appropriate and fair by Booking Simple's high standards of professionalism and conduct

You are considered a Customer in good standing when you have successfully completed 2 billing cycles. Customers in good standing will receive an email notice if account information becomes inaccurate, invalid or incomplete, prior to account termination. You will be given 7 days from the time of notification to correct the situation, after which time Booking Simple maintains the right to immediately terminate service.

Acceptance

At the time of initiating Service, Customer agrees to provide Booking Simple with complete and accurate information. Customer also agrees to use our Service in ethical and legal ways. We maintain the right to track and block IP addresses if we suspect that our systems are being threatened or abused.

Data That You Have Placed In Our Database

All data that You and Your clients have entered into our database is protected under our Privacy Policy, including appointments and client contact information. Booking Simple will not use your account information for any purpose other than normal operations of Our business.

Ownership of URL

Customer agrees that use of the Service does not grant Ownership or other rights to any URL assigned to You by Booking Simple in providing access to Your Account.

Disclaimer of Warranty: THE BOOKING SIMPLE SERVICE IS PROVIDED "AS IS"/"AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. YOU UNDERSTAND THERE MAY BE ERRORS, OMMISSIONS, OR OTHER KINDS OF PROBLEMS. YOU ACKNOWLEDGE THAT THE INTERNET MAY BE VULNERABLE TO FAILURES BEYOND THE CONTROL OF BOOKING SIMPLE. YOU AGREE THAT YOU ARE USING THE SERVICE AT YOUR OWN RISK. WE WOULD NOT PROVIDE THIS SERVICE WITHOUT SUCH LIMITATIONS.

Disclaimer of Liability: YOU AGREE THAT BOOKING SIMPLE IS NOT LIABLE TO YOU OR ANYONE FOR ANY DIRECT OR INDIRECT LOSS OR DAMAGE RESULTING FROM ANY USE OF THE BOOKING SIMPLE SERVICE OR ANY OTHER PRODUCT, OR INFORMATION PROVIDED BY BOOKING SIMPLE. YOUR SOLE RECOURSE IS TO CANCEL YOUR SUBSCRIPTION AND TERMINATE YOUR USE OF THE SERVICE.
